1. Agreement

By using OD Benchmark.com ("the Site"), you agree to these Terms & Conditions. The Site is operated by OD Benchmark ("we," "us," or "our").

2. Description of Service

OD Benchmark.com provides optometrists with benchmarking reports based on publicly available government data (Medicare Part B, NPPES, and related CMS datasets). The basic report is free. A paid upgrade ("Full Report") is available for a one-time fee of $19.95 and includes additional analysis such as CPT code breakdowns, revenue opportunity estimates, and website content audits.

3. Accuracy & Disclaimers

All data is derived from publicly available government records and is provided for informational and educational purposes only. Reports are not legal, medical, financial, or tax advice. Figures are estimates and may not reflect current or complete information. We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any report.

4. Payments

Payments for the Full Report are processed by Paddle.com, our Merchant of Record. Paddle handles billing, sales tax collection, and payment processing. By completing a purchase, you also agree to Paddle's terms of service at paddle.com/legal/terms.

5. Intellectual Property

All site content, design, and software are the property of OD Benchmark. You may not reproduce, distribute, or create derivative works without written permission.

6. Limitation of Liability

To the maximum extent permitted by law, OD Benchmark shall not be liable for any indirect, incidental, special, or consequential damages arising from use of this Site or its reports.

7. Governing Law

These Terms are governed by the laws of the State of Alabama, USA.

8. Changes

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
